Professor Qi Yanping of BIT published a paper in China Legal Science

Recently, Professor Qi Yanping of Beijing Institute of Technology (BIT) published a paper entitled “Legal Regulation in the Society of Digital Intelligence” in China Legal Science, one of the three core journals in the field of Chinese jurisprudence. The paper is a milestone achievement of the Ministry of Justice’s 2018 National Key Project on Rule of Law and Legal Theory Research, “Research on Big Data and Cybersecurity Legislation” (Project Approval No. 18SFB1005).

The logic of digital intelligence is human-computer integration, virtual-real isomorphism, and algorithm-led. The structured and modeled social relations of digital intelligence revolutionize the way we know, grasp and intervene in the world. The post mechanism of digital intelligence will govern all behaviors and relationships. The concept of law and jurisprudence will shift from “how to repair and restore society” to “how to discipline and shape society”. The regulation of society by law should shift from “determining the consequences of behavior” to “shaping the logic of behavior”, from dealing with the aftermath to participating in building the “structure” of social relations, from empowerment and relief to the loading and regulation of responsibilities and obligations. The algorithmic and automatic operation of law will become the norm, and the manual operation of law will become the exception. The logic of digital intelligence will destroy the rights-based and judicial-centered legal jurisprudence, and the rights-based jurisprudence will be replaced by the regulatory jurisprudence.

China Legal Science is an academic journal of jurisprudence supervised and sponsored by the Chinese Law Society. It is an excellent journal financed by the National Social Science Foundation and has been ranked the top of the national jurisprudence journals in terms of impact factor for a long time in various evaluation systems. The published papers represent the highest level of Chinese jurisprudence and play an important role in the prosperity and development of China’s jurisprudence theory, the transmission of legal culture and the promotion of domestic and international jurisprudence exchange.
